This is one of a number of lawsuits which Gilman and Pastor, LLP, has prosecuted on behalf of owners of buildings with defective roof shingles. This lawsuit was filing on behalf of all owners of property in California on which Cal-Shakes were installed and whose Cal-Shakes have failed within the term of their written warranty or represented useful service life. Cal-Shakes are roofing shakes that are composed primarily of two materials: cement and wood fiber. We allege that Cal-Shakes are uniformly defective and, when exposed to normal climatic conditions, prematurely crack, delaminate and deteriorate.
When Cal-Shakes are exposed to normal moisture, the wood fiber absorbs water and expands. The expansion of the shakes exerts pressure on the cement causing the shakes to prematurely crack, deteriorate and eventually leak. While Cal-Shakes are typically warranted for thirty years, the warranty excludes payment for labor and material costs for replacement and excludes consequential material costs for replacement and excludes consequential damages.
